1. The Service
Nysus enables a person or organisation (the "Host") to create a shared event that functions as a private, invitation-only social network for that event. Within it, the Host invites participants ("Guests") to contribute and interact through photos, videos, captions, a social feed and stories, comments, reactions, and — where those features are enabled — event chat and direct messages between participants. The Host may organise, moderate, download, export, or remove content in the event.
The Service is intended for lawful event-based sharing. Features, capacity, quality, availability, and retention depend on the event tier and may differ by platform, country, app version, or purchase offer.
2. Eligibility and minors
You must be at least 18 years old to access and use the Service, which is intended for adults only. By using the Service, you represent that you are at least 18 years old.
The Service is not directed to anyone under 18, who must not create an account, join events, or otherwise use the Service. Hosts must not invite anyone under 18. If we become aware that a user is under 18, we may suspend or remove access and delete associated data as described in the Privacy Policy. This rule concerns who uses the Service; photos and videos that depict minors, uploaded by adults with the necessary permissions, are addressed in the promises and permissions section.
3. Host accounts, Guest identities, and access
Hosts currently sign in with Sign in with Apple (on iOS) or Google (on Android), depending on the platform; additional sign-in methods may be added in the future. Guests use an event-specific, device-bound session and may be required to connect a supported social identity (Apple or Google) before posting or messaging. You must provide accurate information, protect credentials and session access, and promptly notify us of suspected unauthorised use.
Event codes and QR codes are access credentials. The Host decides whom to invite and is responsible for distributing and revoking access carefully. Nysus cannot guarantee that an invitation will not be forwarded, copied, photographed, or otherwise shared.
4. Host control and Guest media
The Host controls the event space and album. Subject to the selected tier, these Terms, and applicable law, the Host may keep contributed media in the event, decide who may access it, moderate it, download or export it, and delete it.
A contributor retains the intellectual-property rights they already hold in their content. Uploading does not automatically transfer copyright ownership to the Host or Nysus. Instead, the contributor grants the licences described below so that the event album can function.
Deleting a Guest identity anonymises or removes the Guest's profile identifiers where reasonably possible, but does not automatically delete that Guest's photos, videos, comments, or other contributions from the Host's event. Contributions remain until the Host removes them, the event or Host account is deleted, the applicable retention window expires, or removal is legally required.
5. Your content and licences
You retain ownership of rights you lawfully hold in content you submit ("Your Content"). You grant Nysus a worldwide, non-exclusive, royalty-free licence to host, store, encrypt, decrypt as necessary to provide the Service, reproduce, compress, transcode, create thumbnails and previews, apply a watermark, analyse for safety, transmit, display, and otherwise process Your Content solely to operate, secure, improve, and enforce the Service.
You also grant the Host a non-exclusive, royalty-free licence to access, organise, display, download, export, preserve, and share Your Content for the event and the Host's lawful personal or organisational purposes. You grant other authorised event participants a licence to view and interact with Your Content and, when the Service permits, download or share it.
These licences continue while the content is retained in the event and for a reasonable backup, security, dispute, or legal-compliance period. They do not permit Nysus to sell Your Content as stock media or use it in advertising unrelated to operating Nysus without separate permission.
6. Your promises and permissions
You represent that you own Your Content or have every permission needed to upload it and grant these licences. You are responsible for respecting copyright, trademark, privacy, publicity, image, confidentiality, and data-protection rights.
Before uploading identifiable people, especially children, you must obtain any consent required by law and by the context of the event. Do not upload highly sensitive records, identification documents, financial data, health information, or intimate material unless strictly necessary, lawful, and appropriately authorised.
7. Prohibited content and conduct
You must not upload, create, send, promote, request, or facilitate content or conduct that:
- Is pornographic, sexually explicit, adult, exploitative, non-consensual, or contains prohibited nudity.
- Sexualises, exploits, grooms, endangers, or depicts the abuse of a minor. Suspected child sexual abuse material may be preserved and reported to competent authorities as required by law.
- Promotes hatred, discrimination, harassment, bullying, stalking, threats, or dehumanisation based on a protected characteristic or directed at any person.
- Promotes terrorism, violent extremism, self-harm, suicide, graphic violence, dangerous acts, or criminal activity.
- Violates copyright, trademark, privacy, publicity, image, confidentiality, contractual, or other rights.
- Is illegal, fraudulent, deceptive, defamatory, impersonating, spam, malware, or designed to steal data or access.
- Reveals another person's private data without lawful authority or consent.
- Attempts to evade moderation, access controls, storage limits, rate limits, payment controls, or security measures.
You may not scrape the Service, harvest participant data, reverse engineer protected portions, interfere with infrastructure, resell access, create unauthorised commercial databases, or use the Service to harm another person.
8. Moderation, reports, and enforcement
Nysus uses Host controls, participant reports, automated rules, on-device screening, and AI-assisted analysis to detect prohibited media and text. Content may be rejected before upload, held for Host approval, blurred, restricted, removed, or escalated for review. Automated systems can make mistakes.
We and the Host may take proportionate action, including warning, blocking messaging or uploads, removing content, limiting access, suspending or terminating an identity or account, preserving evidence, and notifying authorities where legally required or reasonably necessary to protect people or the Service.
Report content through the in-app tools or the channel listed in the final section of these Terms, with enough information to identify the event and content. Copyright notices should identify the protected work, the allegedly infringing material, your contact details, a good-faith statement, and confirmation that the notice is accurate and authorised.
9. Event tiers, media quality, and retention
The tier belongs to a specific event. Current configurations include Free, Celebration, and Big Event. The purchase screen and event settings are the controlling description of the features and price offered to you.
A Host may currently create one Free event per month. Free supports up to 50 Guests, uses stronger compression and lower video quality, applies a "Made with Nysus" watermark, disables event chat and direct messages (but supports watermarked and compressed downloads), caps total event storage at around 500 MB, and retains compressed media for up to 7 days under the event lifecycle shown in the app. Once the storage cap is reached, further uploads may be blocked.
Celebration currently supports up to 300 Guests and Big Event up to 1,000 Guests. Paid tiers currently enable chat and direct messages for a 48-hour window, downloads of original photos, higher-quality compressed media, and compressed-media retention for up to 365 days. Original photos, but not original videos, are currently retained for Host download for up to 30 days on Celebration and 60 days on Big Event.
A paid renewal may extend compressed-media retention for another year, but does not reopen or extend an expired original-photo window unless the purchase screen expressly says so. Hosts must download or export media before the applicable window expires. Retention may be shortened where content is removed for safety, law, non-payment, technical integrity, or account/event deletion.
10. Purchases, pricing, and refunds
Paid tiers and renewals are one-time, consumable purchases for a particular event, not recurring subscriptions unless the purchase screen expressly states otherwise. Prices may vary by country, platform, tax, currency, and offer or A/B test. The final price and features are displayed before confirmation.
Apple App Store or Google Play processes the transaction, while Superwall helps present purchase offers and record entitlements. Store terms also apply. Refund requests are handled under the store's procedures and mandatory consumer law. Nothing in these Terms excludes a statutory cancellation, refund, or conformity right that cannot legally be waived.
A consumable is used when credited to, created for, or applied to an event. You may not transfer, resell, duplicate, or reuse an event purchase unless the Service expressly permits it.
By completing the purchase and applying the consumable to your event immediately, you expressly request and consent to performance beginning before the end of any statutory cancellation or withdrawal period, and you acknowledge that, once the service has been fully performed, you lose that right of withdrawal to the extent permitted by applicable law. This does not affect non-waivable consumer rights or any right arising from a defective or undelivered service.
11. Host responsibilities
The Host is responsible for event information, invite distribution, participant management, lawful use of exported media, obtaining event and image permissions, responding to participants, and downloading media before expiration. Hosts must use moderation tools reasonably and may not use their control to harass, discriminate, retaliate, or violate the law. In particular, the Host is responsible for obtaining the permissions required for images of any minors present at the event.
Nysus is not a permanent archive or professional backup service. Hosts should maintain independent copies of important media and must not rely on the Service as the only copy.
12. Event visibility and privacy
Events are designed to be shared with invited participants, but they are not guaranteed to be confidential. Anyone with valid access may view content, take screenshots, make recordings, or redistribute content outside Nysus. Technical controls cannot prevent every misuse by another participant.
Use anonymous posting and sharing controls carefully. An anonymous label may hide a display name from other participants, but Nysus may retain technical identifiers needed for security, moderation, and legal compliance.
13. Deletion, suspension, and termination
A Guest may delete their Guest identity through the Service. This removes or anonymises profile and connected-social identifiers across associated event identities, but contributions remain in the Host's albums as described above.
A Host may delete their account, which is intended to delete the Host profile, owned events, and associated event content. Used events moved to trash may remain restorable for up to 30 days before permanent purge; unused events may be deleted sooner. Limited logs or backups may remain where required for security, fraud prevention, legal claims, or law.
We may suspend or terminate access where you breach these Terms, create legal or safety risk, fail to pay, abuse the Service, or where necessary to protect the Service. You may stop using the Service at any time.
14. Third-party services
The Service depends on providers including app stores, authentication providers, cloud database and storage providers, edge-network providers, content-moderation providers, and purchase-management providers. Their own terms and privacy notices may apply to their services.
Nysus is not responsible for third-party products, websites, outages, or conduct outside our reasonable control, but remains responsible for its own legal obligations when selecting and using service providers.
15. Nysus intellectual property
Nysus and its licensors own the Service software, design, branding, logos, and related materials, excluding Your Content. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for its intended purpose while these Terms apply.
You may not copy, sell, sublicense, modify, distribute, or create derivative works from protected Service elements except where applicable law expressly permits it. Feedback may be used by Nysus without payment or confidentiality obligation.
16. Changes and availability
We may add, modify, suspend, or discontinue features to maintain security, comply with law, respond to provider changes, or improve the Service. We will provide notice where required by law and will not remove paid rights already owed without an appropriate remedy required by law.
Scheduled maintenance, emergencies, internet failures, provider outages, force-majeure events, or other conditions may make the Service temporarily unavailable.
17. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available". We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not endorse or guarantee participant content, event legitimacy, permissions obtained by a Host or contributor, moderation accuracy, or permanent media availability. These disclaimers do not limit mandatory statutory guarantees or consumer rights.
18. Limitation of liability
To the maximum extent permitted by law, Nysus and its suppliers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for lost profit, opportunity, goodwill, or data, arising from the Service or another user's conduct.
Where liability may legally be limited, our aggregate liability arising from the Service will not exceed the greater of the amount you paid for the affected event in the 12 months preceding the claim or US$100. This limit does not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that law does not permit us to exclude or limit.
19. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold Nysus harmless from third-party claims and reasonable costs arising from Your Content, your event, your unlawful use, your breach of these Terms, or your violation of another person's rights. This obligation does not apply to the extent a claim was caused by Nysus's own unlawful conduct.
20. Governing law and disputes
These Terms are governed by the laws of the Federative Republic of Brazil, without excluding mandatory consumer, privacy, or other protections of your country or state of residence. Before filing a claim, use the channel listed in the final section of these Terms so the parties can attempt an informal resolution.
Courts with jurisdiction under applicable law may hear disputes. Nothing here forces a consumer to waive a mandatory venue, small-claims procedure, regulator complaint, collective remedy, or other non-waivable right.
21. General terms
If part of these Terms is unenforceable, it will be adjusted only as necessary and the remaining terms will continue. A failure to enforce a term is not a waiver. You may not assign your rights without our consent; we may assign these Terms as part of a merger, reorganisation, financing, or sale, subject to applicable law.
These Terms and the Privacy Policy form the agreement about the Service, together with purchase terms shown at checkout and any mandatory store terms. Sections intended by their nature to survive termination will survive.
22. Changes and contact
We may update these Terms. Material changes will be communicated through the Service or another appropriate channel before taking effect where required. The effective date above identifies the current version.
